MLI author Dwight Newman spoke to the Globe and Mail on a Supreme Court decision on Aboriginal land title rights released on Thursday that has major implications for natural resource development projects.
The decision expands the rights of Aboriginal groups to control ancestral lands.
Newman told the Globe that the decision “expands the challenge for Enbridge in terms of the consultation” for its major pipeline, Northern Gateway.
Enbridge, which received conditional approval last week from the federal government for the project, is currently consulting with Aboriginal groups on the project.
Newman is the author of the MLI paper “The Rule and Role of Law: The duty to consult, Aboriginal communities and the Canadian natural resource sector.”
