With the rise of the digital economy, the prominence of “big tech” has raised an important question: does competition law need a fundamental rethink? Or can more modest changes allow longstanding tools to be effectively applied to promote competition to the benefit of consumers?
This fall, the federal government will be launching a consultation on potential reforms to the Competition Act. What do the recent changes to the Competition Act passed as part of last spring’s budget potentially foreshadow? What further reforms should the government consider and which should they steer clear of? And what are the risks of trying to enlist competition law to address a broader set of concerns?
