Worries about treading on Parliament’s policy-making function are now a subject of open debate at the Supreme Court of Canada.
Benjamin Perrin discussed concerns about the Court overstepping its bounds, a subject he raised in his paper “Dissent From Within At The Supreme Court of Canada”, with the Ottawa Citizen.
“There has emerged a vocal cadre of judges within the court that’s raising the alarm the court is intruding on Parliament’s policy-making domain and saying, ‘Hold on, Parliament is supposed to make these decisions and we’re not supposed to usurp that role.’ That is a very significant development,” Perrin told the Citizen.
Perrin did a series of interviews with CBC Radio One stations across the country, including Ottawa, Vancouver, Winnipeg and Whitehorse. The paper was also the subject of an article in Canadian Lawyer.
