MLI’s recently-released report on the government’s constitutional ‘duty to consult’ with Aboriginals has appeared in a story in the Yukon News. Dwight Newman, author of “The Rule and Role of Law: the duty to consult, Aboriginal communities, and the Canadian natural resource sector“, told the newspaper the duty to consult is creating different situations between First Nations that have signed final agreements with the government and those that haven’t. Newman’s paper argues that the doctrine should be used as a “lever” that brings governments, Aboriginals and businesses together to reach a consensus around natural resource development.
